1. Definitions

1. Agreement: if the client accepts an offer, it becomes an agreement
2. Training: a number of lessons that belong together
3. Lesson: any training consists of a number of lessons
4. Client: the company/organization that purchases the training for one or several of its employees, or an individual
4. Student: the individual in training
5. Efficiënt Frans Leren: the organization that provides the training

2. Agreement
An agreement is concluded by acceptance of an offer. The client is entitled to cancel the agreement free of charge without giving any reason for 14 days following the conclusion of the agreement.

3. Cancellation before the Start of the Training
If a client decides to cancel the training prior to the start date, they owe part of the agreed fee.
3.1 A client who cancels up to a month prior to the start date owes 10 percent of the agreed fee.
3.2 A client who cancels less than a month prior to the start date owes 25 percent of the agreed fee.

4. Cancellation after the Start of the Training
4.1 If a student wants to cancel the training once it has started, Efficiënt Frans Leren will contact the client. Another student can take the vacant place within three months.
4.2 If a client wants to cancel the agreement once the training has started, they will be charged for 50 percent of the remaining hours.

5. Unable to Attend Training
5.1 If a student taking part in a group training is unable to attend a planned lesson, the lesson will take place nonetheless. If a student that takes part in individual lessons is unable to attend a planned lesson, they have to cancel that lesson by email at least 48 hours in advance. Efficiënt Frans Leren will then postpone the lesson.
5.2 If a student cancels a planned lesson less than 48 hours in advance, the client will be charged for that lesson.
5.3. If the trainer is unable to attend a planned lesson, they will inform the student(s) by email at least 48 hours in advance. The lesson will be postponed in consultation with the student(s). In case of long-term unavailability, another trainer will take over the lessons.

6. Fee
Efficiënt Frans Leren is entitled to increase the agreed fee if and when unforeseen costs-adding conditions (such as VAT/tax) arise after the conclusion of the agreement, or after sending the offer.

7. Payment
The client will receive an invoice at the end of each calendar month. This invoice must be paid within eight days.

8. Confidentiality
Efficiënt Frans Leren is committed to absolute secrecy with regard to the information made available by the client and the students.

9. Intellectual Property

9.1 Efficiënt Frans Leren reserves all rights to the material it has created.
9.2 Without the written permission of Efficiënt Frans Leren, the teaching materials mentioned in the preceding paragraph may not in whole or in part be copied or shown to third parties, handed over or made public in any way, nor be used by the client or made available otherwise than for the purpose for which they were provided by Efficiënt Frans Leren.

9.3 The client will protect Efficiënt Frans Leren against infringements of intellectual property rights of third parties.

10. Questions and Complaints
10.1 If a student has a complaint about a course, they must first discuss this complaint with the trainer. If this does not lead to a satisfactory solution, the student can within a reasonable period of time file a written complaint with Efficiënt Frans Leren.
10.2 Efficiënt Frans Leren will respond to questions of an administrative nature, questions about the content of the training and to complaints within ten working days.
10.3 Efficiënt Frans Leren will handle all complaints confidentially.
10.4 If complaints are not handled satisfactorily, the student can apply to the arbitration committee (Dhr. Vliegenthart, ls-Gravenweg 400, 2905 LC Capelle aan den IJssel). The cost of submitting a complaint is € 75.
10.5 The decision of the arbitration committee is binding.
10.6 After processing, a complaint will be kept on file for a period of at least one year.
